COLUMBUS, OH - A teenage girl who converted to Christianity and ran away from home is being blocked by her Muslim parents from fighting the possibility of deportation.
 
The teen's lawyer has asked a judge in Columbus, Ohio, to sign an order stating that reunification with her parents is not possible by her 18th birthday in August. The order would allow Rifqa Bary, who is in foster care, to apply for special immigration status without her parents' consent.

An attorney for her parents objected saying the parents previously filed an immigration application for the whole family.

Bary, who is 17, fled home last year and stayed with a Florida minister whom she met on Facebook. She is an illegal immigrant and does not want to be returned to her native Sri Lanka because she fears being harmed or killed by Muslim extremists.

Rifqa Bary turns 18 today. The Christian convert who has been the center of a high-profile custody dispute with her Islamic parents received two positive rulings from an Ohio judge that will make it easier for her to remain in the United States.
 
Last week a juvenile court judge in Ohio granted Rifqa Bary's request to declare reunion with her Muslim parents impossible, paving the way for the girl to fight deportation. Magistrate Mary Goodrich said Thursday that reconciliation between the teenager and her parents would not be possible before her 18th birthday. Goodrich also said it was not in the girl's best interest to return her to her native Sri Lanka. (See related story)
 
The ruling permitted Bary's attorneys to file for special immigration status that allows her to remain in the U.S. while she continues medical treatment following recent surgery for uterine cancer. The teenager ran away to Florida last year because she feared her father would harm or kill her for converting from Islam.
 
ImagePastor Jamal Jivanjee is a convert from Islam who has been advising the teenager. He was pleasantly surprised at the judge's ruling after months of haggling over a reunification plan with her parents.
 
"The judge kind of hung that over their heads for the last eight months and [saying basically that] we've got to let this reunification plan take its course," he observes. "And they were basically running the clock out on her -- so better late than never, that's what I say.
 
"You know, five days before she turns 18 they basically declare that yeah, she's not going to go home -- which is kind of obvious," says Jivanjee. "And then...the fact that they have made a recommendation that she should not be returned to Sri Lanka is a good thing."
 
Jivanjee says he is hopeful that Bary will eventually get her green card, allowing her to remain in the United States to work or further her education.
